1. Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Kaus AI Ltd, a company incorporated in England and Wales (doing business as "ShowMeViral", "we", "us", or "our"), governing your access to and use of the website https://www.showmeviral.com and all related products, features, and services (collectively, the "Services").
By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.
2. Eligibility
You must be at least 13 years old to use the Services. If you are under 18, you confirm you have permission from a parent or legal guardian. By using the Services, you represent and warrant that you meet these eligibility requirements.
3. Description of the Services
ShowMeViral is a trend intelligence SaaS that helps content creators and businesses discover, analyze, and remix viral videos. We collect publicly available data and use artificial intelligence (AI) to provide analysis and recommendations. The Services are intended for both personal and internal business use.
4. Your Account
To access certain features, you must create an account using a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use or security breach.
We may suspend or terminate your account, without refund, if we believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Services or other users.
5. Subscriptions and Payments
We offer paid subscription plans and credit packs (collectively, "Paid Plans") with prices denominated in British Pounds (GBP). All payments are processed securely by our third-party payment processor, Stripe, Inc.
Subscription billing. Paid subscriptions automatically renew at the end of each billing period at the then-current rate, unless cancelled by you before the renewal date.
Accepted payment methods: Visa, Mastercard, American Express, Discover, and other major debit and credit cards processed through Stripe.
Price changes. We may change subscription prices from time to time. Price changes will not apply to existing billing cycles but will take effect on the next renewal. We will provide notice in advance of any such change.
6. Cancellation
You may cancel your subscription at any time by logging into your account and managing your subscription via our Stripe Customer Portal at /account. Cancellation takes effect at the end of your current billing period — you retain access to paid features until then.
7. Refunds
All purchases are final and non-refundable, except where required by applicable law.
UK consumers: digital content right to cancel. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have a 14-day right to cancel purchases of digital content. However, by completing your purchase and accessing the Services (including subscription features, AI-generated analysis, or credits), you expressly consent to immediate delivery of digital content and acknowledge that you waive your right to cancel.
Unused credits are non-refundable and may expire as stated at time of purchase.
8. Acceptable Use
You agree not to, and will not permit any third party to:
- Use the Services to advertise or offer to sell goods or services without our permission.
- Sell, transfer, sublicense, or otherwise make your account available to any third party.
- Scrape, copy, index, or redistribute data obtained from the Services to third parties or competing products.
- Reverse engineer, decompile, or attempt to extract the underlying algorithms or source code.
- Use the Services to violate any law, regulation, or third-party right.
- Interfere with or disrupt the integrity or performance of the Services (e.g., denial of service attacks, malware).
- Circumvent any usage limits, rate limits, or security measures we put in place.
- Use the Services in any manner that could harm minors or that is otherwise inappropriate.
Violation of this section may result in immediate termination of your account and, where appropriate, legal action.
9. Intellectual Property
The Services, including all content (other than User Content and Third-Party Content described below), software, design, trademarks, logos, and underlying technology, are owned by Kaus AI Ltd or its licensors and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business use, subject to these Terms.
10. Third-Party Content
The Services display publicly available content from third-party platforms (including but not limited to TikTok videos, creator profile information, and metadata). All such content remains the property of its respective owners. We do not claim ownership of third-party content and are not responsible for its accuracy, legality, or availability.
The Services may contain links to third-party websites (such as TikTok, Stripe, and others) that we do not own or control. We are not responsible for the content, privacy practices, or policies of any third-party website.
11. AI-Generated Output
The Services use third-party AI providers (including Anthropic) to generate analysis, recommendations, and scripts ("AI Output"). AI Output is provided "as is", may contain errors, and should not be relied upon as professional, legal, financial, or medical advice. You are responsible for reviewing and verifying AI Output before relying on it or republishing it.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, secure, or that defects will be corrected. We do not guarantee the accuracy, reliability, or completeness of any content or AI Output.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KAUS AI LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED BRITISH POUNDS (£100 GBP).
Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for fraud or death or personal injury caused by our negligence.
14. Indemnification
You agree to indemnify, defend, and hold harmless Kaus AI Ltd and its directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms, (b) your misuse of the Services, or (c) your violation of any third-party right or applicable law.
15. Dispute Resolution
Informal negotiation first. Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting us at helena.w@kaus-ai.com. The parties agree to engage in good-faith negotiations for at least 30 days before pursuing arbitration.
Binding arbitration. If informal negotiations fail, any dispute arising out of or relating to these Terms shall be finally resolved by binding arbitration seated in London, United Kingdom, conducted in English, under the rules of the London Court of International Arbitration (LCIA).
Class action waiver. You agree that any dispute must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you either by posting a notice on the Services or by sending an email to your registered address. The updated Terms will be indicated by the "Last updated" date at the top. Continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
18. Termination
You may terminate these Terms at any time by ceasing use of the Services and deleting your account via /account. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or if required by law. Sections that by their nature should survive termination (including Sections 9, 12–16) will survive.
19. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them freely.
